      Josiah Dennis is on the 1829 Assessment of Walpole. After he came to Walpole Township Josiah Dennis and his family lived on Lot 17, Concession 1, Walpole where he farmed land owned by Samuel Swarts, Sr. His family grew up here and in 1850 he purchased the north half of Lot 20, Concession 3, Walpole, where he and his wife lived the remainder of their lives

      JOSIAH DENNIS' WILL

      Copy of the original will of Josiah Dennis of the Township of Walpole in the County of Haldimand and Province of Canada yeoman, for the purpose of the registration of the same, in accordance with the "Registration of Titles (Upper Canada) Act" section thirty six.
      In words and figures following viz:

      "Will"

      "I Josiah Dennis in the Township of Walpole in the County of Haldimand and Province of Canada, yeoman, being in feeble health and of sound and disposing mind and memory do make and publish my last will and testament hereby revoking all former wills by me at any time heretofore made.

      First - I hereby constitute and appoint Elizabeth Dennis my wife and John McClelland, of the Township of Walpole aforesaid as executrix and executor to pay all my just debts and funeral expenses and the legacies hereinafter given out of my estate.

      Second -I give and bequeath to my WIFE ELIZABETH DENNIS the full use and privilege emoluments and profits of all my real estate and as much of my personal property as may remain unsold after paying my just debts and funeral expenses as aforesaid, to her own use and benefit as long as she shall live and in case the use thereof shall not be sufficient to give my said wife a comfortable maintenance then much of the said personal property as my said executrix and executor may deem necessary may be sold the proceeds applied to the use of my said wife Elizabeth Dennis.

      Third - After the death of my said wife Elizabeth Dennis I give and bequeath to my SON NELSON DENNIS the North East quarter of Lot no. twenty in the third Concession of the aforesaid Township of Walpole. Also to my son William Dennis the North West corner of the said Lot as follows Commencing at the road allowance of the said Lot thence along the fence Southerly now erected on the said Lot to where a pair of posts are now placed to receive bar rails thence westward parallel with the Concession line to the limit between nineteen and twenty, thence Northerly to the Concession line thence Easterly along the same to the place of the beginning (five acres more or less). Also to my SON JAMES DENNIS all the rest of the North West Quarter of Lot number twenty as aforesaid only that I have given to my SON WILLIAM DENNIS as aforesaid and in case my son William aforesaid should see fit to remove to a distance and dispose of his lot then my son James to have the first chance of purchase and in case my son James and my son William cannot agree as to the price and terms then the same to be left to arbitration each one choosing a representative and in case the two so chosen not being able to agree then the two chosen shall select one whose decision shall be final and in case my said son James shall still refuse to abide said decision then my said son William may sell to whom he chooses, not withstanding any thing herein contained. Also to the issue of my DAUGHTER MARGARET McCLELLAND deceased the sum of one dollar share and share alike to my DAUGHTER SUSAN FORSYTH the sum of one dollar to my DAUGHTER MARY GROW the sum of one dollar to my DAUGHTER ELIZABETH DENNIS the sum of forty dollars to my DAUGHTER CAROLINE DENNIS the sum of forty dollars.

      Fourth - And for the payment of the aforesaid Legacies I order my son Nelson Dennis and my son James Dennis respectively to pay the sum of forty one dollars and fifty cents to be paid in a period not exceeding two years after my decease when the same shall be paid over to the persons aforesaid.

      Fifth - After the decease of my said wife Elizabeth Dennis and all necessary expenses connected with her funeral expenses being paid then the balance of all my personal property to be sold and divided as follows to my daughter Mary Grow my daughter Susan Forsyth and my daughter Elizabeth Dennis and my daughter Caroline Dennis share and share alike.

      "In witness whereof I hereunto set my hand and seal and Publish and declare this to be my last will and testament in the presence of the witnesses named below this tenth day of April one thousand eight hundred and sixty two.

      I William Davis of the Township of Walpole in the County of Haldimand and Province of Canada yeoman make oath and say that I was Present and did see Josiah Dennis late of the Township of Walpole in the County of Haldimand, yeoman, now deceased, duly execute his Will of which the foregoing is a true copy, in the said Township of Walpole also that I am one of the subscribing witnesses of the said Will and that I know the said Josiah Dennis.

      I certify that the foregoing oath of proof was sworn before me at Cayuga in the County of Haldimand this 25 day of January A D 1866, at 17 minutes past two o'clock P.M.
