      Affidavit of Execution of Will
      In the Surrogate Court of the County of Elgin,
      In the goods of David Hoover, Yeoman deceased.

      I John Gilbert Manning of the township of Westminster in the county of Middlesex, Yeoman make this oath and say:

      That I knew David Hoover late of the township of Yarmouth in the County of Elgin, Yeoman deceased. That on or about the tenth day of May in the year of our Lord One Thousand Eight Hundred and sixty nine I was present and did see the said David Hoover sign and declare the paper writing hereonto annexed, as and for the last Will and Testament of the said David Hoover.

      That I, deponent and Jacob Isaac Manning in the Township of North Dorchester in the County of Middlesex, Yeoman did subscribe our names as witness to the execution of the said Will at the request of the said Testator, and in presence of each other; and lastly that the several names subscribed as witness to the execution of the said Will are of the proper handwriting of this deponent and the said Jacob Isaac Manning respectively.

      Sworn before me at St. Thomas in the County of Elgin this Twenty Third day of June, A.D. 1870. Signed J.I. Manning

      I Chys John Hoover of the township of Yarmouth in the County of Elgin, Yeoman make oath and say:

      That I believe the paper writing hereto prefixed marked A to contain the true and original last Will and Testament of David Hoover late of the township of Yarmouth in the county of Elgin, Yeoman, deceased.

      That I am one of the executors therein named, and that I will faithfully administer the personal Estate and Effects of the said Testator by paying his just debts, and the Legacies contained in his Will so far as the same will thereunto extend, and the law bind me; and that I will exhibit a true and perfect Inventory of all and singular the personal Estate and Effects, Rights and Credits of the said Testator and render a just and full account of my executorship whenever required by law so to do.

      Executors’ Application for Probate
      Into the Surrogate Court of the County of Elgin

      The petition of David Leamon Hoover of the Township of North Dorchester in the County of Middlesex Butcher, Joseph Ephraim Hoover of the township of Yarmouth in the County of Elgin, Yeoman, and Chrys John Hoover of the Township of Yarmouth in the County of Elgin, Yeoman.

      Humbly Sheweth,

      That David Hoover
      late of the Township of Yarmouth in the County of Elgin, Yeoman, deceased, died on or about the ninth day of May in the year of our Lord one thousand eight hundred and seventy at the Township of Yarmouth in the County of Elgin, and that the said deceased at the time of his death had his fixed place of abode at the Township of Yarmouth in the said County of Elgin.

      That the said deceased in his life time duly made his last Will and Testament, bearing date the Tenth day of May in the year of our Lord one thousand eight hundred and sixty nine.

      That your Petitioners and executors names in the said Will.
      That the value of the personal Estate and Effects of the said deceased which he in any way died possessed of, or entitled to, and for and in respect to which a Probate of the said Will is to be granted, are of or about the value of three hundred dollars, to the best of your Petitioners knowledge and belief.

      Wherefore your Petitioners pray the Probate of the said Will of the said deceased may be granted to them by this Honourable Court.

      I David Hoover of the Township of Yarmouth in the county of Elgin Ontario being of sound disposing mind and understanding, do make publish and declare this to be my last will and testament here by looking and speaking voids all former last wills and testaments by inactivate (?) before made.

      My will is first that my Funeral Charges and just debts shall be paid by my Executors here in after -----(?)
      The Executors of my Estate and property which shall --–(?) be required for the payment of my just debts Funeral charges, and the expenses attending the execution of this my last will and the administration of my estate. I give and devise and dispose there of so follows, to wit. I give and devise to my beloved wife Elizabeth for and during her natural life time, the use and benefits of all my real estate and household furniture and effects those belonging after my decease the real estate being composed of the sixteenth lot in the fourteenth concession of the Township of Yarmouth. Save and Except one acre leased to Susana Bradt (looks more like Bratt), on the North West and of the said lot number sixteen in the said Township of Yarmouth.

      I also will and dispose and bequeath to my daughters the following bequeath that is to my daughter Mary fifteen dollars. My daughter Susanna two dollars, Ann, fifteen dollars. My daughter Elizabeth five dollars, Caroline fifteen dollars, Catherine fifteen dollars, Duleena fidelia fifteen dollars. I also will and bequeath to my Son Samuel seventy five dollars. Each and every year during his natural life time after my wife’s decease. I also will and bequeath to my Grandchildren Mary Ann (looks like Mercy Ann) Hoover, and Elizabeth Jane Hoover, John Henry Hoover and Menno (looks like Mano) Simon Hoover. Heres of my son Henry two dollars each and I also will and bequeath to my sons David Leamon, and Joseph Ephraim and Chrys John after my wife’s decease. My farm of lands above described to be equally divided share and share by their paying and settling all

      This above bequeath I also bequeath and order in this my will and testament that the proceeds of my farm above mentioned shall be applied to the paying of the above bequeaths after my wife Elizabeth’s death and I also bequeath that my sons Joseph Ephraim and Chry John shall leave(?)the ----(?) of working my farm during the natural life time of my wife Elizabeth and that my wife Elizabeth shall leave the privilege of disposing of the house hold furniture as she thinks -----(?) and my will is that my executors shall have all other personal property to pay debts and legacies and my wife is that my daughters and grandchildren shall be paid their bequeath in one year after my wife’s decease.

      And I do nominate and appoint my sons David Leamon and Joseph Ephraim and Chys John to be executor to this my last will and testament.

      This testimony whose of the said David Hoover have----(?) subscribed my name and affixed my seal this the tenth day of May in the year of our Lord one thousand eight hundred and sixty nine.
