      I George Byer of the Township of Walpole in the County of Haldimand in the Province of Canada Yeoman Being in perfect health Both of Body and Mind blessed be Almighty God for the Same, but Taking into Consideration the uncertainty of Life and the Certainty of Death and that in health and life is the time to prepare for Death do make and publish this my last Will and Testament in manner and form following (that is to say) I give and Bequeath to my beloved wife Susan the full free and undisturbed use and occupancy of my homestead or real Estate for and during her natural life Should So long remain my Widow or so long as She may So remain. Should She Survive me and after her Death or Marriage, to be sold and the proceeds to be Disposed of as hereinafter Provided.

      I also give and Bequeath to my aforesaid wife to her and her heirs all my personal property - Goods and Chattels rights and Credits of what name or Nature Soever after the full payment of all my just debts and funeral Expenses and should any part of my personal Estate after her Death remain undisposed of to be divided in the same manner as the proceeds of my real Estate is to be divided unless She may during her life otherwise direct.

      I order and direct that after the Death or Marriage of my Said Wife that my farm shall be sold by the Executors who are fully authorized so to do and to make title to the purchaser or purchasers and to their heirs and assigns For Ever, and after payment of my Expenses attending the Sale or making title to divide the proceeds into two equal parts and the one part or half to be equally divided between my Three Sons David, George and Henry and

      should either of these three Die during minority or without heirs then their share to fall to the Survivor or Survivors of the Brothers or their heirs and assigns.

      The other part or half to be divided equally between my Five Daughters Ann Hester Maria Matilda and Isabella, and should one or more of them Die during minority or without heirs their Shares to be equally divided amongst the Surviving Sisters or their heirs or assigns.

      I hereby appoint as Executors of this my last Will and Testament my two Sons David Byer and George Byer hereby revoking all former Will or Wills by Me Made.

      In Witness whereof I have hereunto Set my hand and Seal this fourteenth day of March in the Year of our Lord one thousand Eight hundred and Fifty.

      Overplus of South Part
      George Byer has a deed for the adjoining part of this Lot on which he resides - has undisputed possession of the overplus - which is all clerared and an old orchard thereon. I am informed by Daniel Hoover that Captain John Doxtader carried on a trade at this place with the Indians about the year 1780 - at which time he cleared some 15 or 20 acres of the overplus, there are no buildings thereon.

      Personaly came before me William Steel Esquire of His Majestys Justices of the Peace in and for the said County Susan Boyer Wife of the late George Boyer of Walpole Deceased and Saith on her affirmation that her Late husband Did not During his lifetime Sell or Dispose of any Part of Lot No. twenty four front Concession on the south part or has any other Person since his Death Sold any Part thereof. Since the report of the Deputy Surveyor in March Last. Supposed to contain by admeasurement twenty four acres Which her late husband held under title.

      George Wolfe witnesses Norfolk Instrument No. 31, B & S dated August 26th, 1800, for 2000 acres of land in Walpole and Rainham Townhips from Captain John Dochstader to David Hoover as "George Wolfe, Fuller, of the Township of Walpole." George Wolfe purchases all of Lot 23, Concession 2, Walpole, 200 acres, from David Hoover on September 13th, 1800. His wife Susannah receives the front part of Lot 24, Concession 1, Walpole, 100 acres, from her brother David Hoover on September 13th, 1800.

      George Wolfe is accused of being a Traitor during the War of 1812 and about 1813 moves to Clarence, New York. His 200 acres are confiscated by the Forfeited Estates Commission. George Wolfe of the Township of Clarence, in the County of Erie, State of New York, Yeoman, and Susannah his Wife, sell her 100 acres to George Boyer in 1834.
