The Instrument was Registered July 1st, 1851. Joseph Gee received the Crown Patent to Lot 2, Concession 5 Rainham on November 4th, 1846, all 200 acres. By Instruments No. 3997, 3998, 3999 and 4000 dated August 8th, 1853 and registered January 5th, 1856 these two lots are divided by a Deed of Gift amongst four of his sons [100 acres each] viz: Uriah, Hiram, Ephraim and Abraham, from his marriage to Susannah Hoover. The north part of Lot 1, Concession 3, Rainham, 90 acres inherited by his wife Susannah from her father Abraham Hoover went to their son Jonathan. No. 87 In the Surrogate Court of the County of Haldimand By John Gustavus Stevenson Esquire Judge of the Surrogate Court of the County of Haldimand in the Province of Canada. To all whom these presents shall come Know ye that on the day and date hereof was proved and affirmed and sinsinuated the last will and Testament of Joseph Gee late of the Township of Rainham in the County of Haldimand and Province of Canada Esquire deceased having whilst he lived at the time of his death goods rights credits and chattels within the said County of Haldimand a true copy whereof is hereunto annexed and the execution of the said last will and Testament is hereby committed unto Uriah Gee of the Township of Rainham, Yeoman the executor in the said will named he having been duly sworn well and faithfully to administer all and Singular the goods rights credits and chattels which are of the said Joseph Gee deceased and to exhibit a true full and perfect Inventory thereof together with a just and true account of his said administration into the Registry of the Surrogate Court of the said County of Haldimand when thereto lawfully required. Given under my hand and seal of the said Court at Cayuga in the said County of Haldimand the Twenty first day of March in the year of our Lord One Thousand Eight Hundred and fifty six. Sd/ John G. Stevenson Surrogate Robt V Griffith Registrar "Will" I Joseph Gee of the Township of Rainham in the County of Haldimand in the Province of Canada Esquire being of sound and disposing mind memory and understanding do make and publish this my last will and Testament hereby revoking all wills heretofore made by me. I order and direct that all my just debts and Funeral Expenses shall be paid by my executors with as little delay as they can avoid out of my personal property and having heretofore my Deeds Conveyed to my sons Uriah, Abraham, Hiram and Ephraim and all my freehold Estates to my son Jonathan being provided for by the Inheritance which belonged to his mother, I now leave devise and bequeath to my Executors the entire of my personal property upon trust for the uses and purposes hereinafter mentioned, that is to say, So soon as circumstances will permit to purchase one hundred and fifty Acres of Land in some eligible situation the price of which not to exceed three pounds per acre, the same to be divided into fifty acre lots for each of my daughters Lydia, Kezia and Mary Jane, to become their respective estates for ever on their severally attaining the age of twenty one years, And another piece of Land of fifty acres for the use and behoof of my wife Margaret during her life and after her death to go and belong to my son Joseph as his estate forever, And my will is that the fifty acres so purchased for my wife and son Joseph shall have Such improvements made thereon as will yield a comfortable support for her and him, And my will is that each of my Daughters shall also receive from my Executors one Cow, one Bedstead, bed and bed clothing on their respectively attaining the age of Twenty one years or days of marriage which ever shall first happen and that my wife shall receive two Cows with one bedstead bed and bed clothes at any time she may require them - And in case either of my Daughters should die before they attain the age of Twenty one years, unmarried or if married leaving no issue of said marriage my will is that the fifty acres of land purchased for such daughter shall be sold and the proceeds thereof divided amongst my surviving daughters and my son Joseph share and share alike, but should either of them die leaving legal issue then my will is that the land of such daughter shall be appropriated as a support of such issue and on their attaining the age of Twenty one years to suffer them to inherit the same as their Estate forever, 'if more than one child, share and share alike, if only one then to that child , and if my son Joseph should die before his mother leaving no legal issue, My will is that the fifty acres appropriated for his estate shall after the death of his mother be sold and the proceeds given to my daughters or their survivors share and share alike - And I further desire and my will is that if my personal property shall prove sufficient to purchase the fifty acres of land for each of my Daughters and the fifty acres for my wife and son Joseph with out the Sale of such stock as may be necessary to keep on the farms given to my Sons, My will is that my Executors may dispose of such stock amongst my sons or such of them as they shall consider most deserving. And I hereby appoint my son Uriah Gee and my friend William Holmes both of the Township of Rainham Executors to this my last will and Testament and I also appoint them Guardians to my children with perfect confidence that they will use their best efforts in promoting their education, and carrying out my wishes with respect of their future Welfare. Havill Division Registrar of Rainham From Rainham Mennonite Farm Logs - Researched by David McClung Lot 4, Concession 2, Rainham - June 14, 1844 - Henry Miller of Rainham, yeoman, sold 100 acres of the east half to Solomon Fess of Rainham, farmer, for 150 pounds. The property measured 27 chains and40 links in length and 14 chains and 90 links in width. The transaction was witnessed by Christian Sherk of Rainham, yeoman, Menonist, and James M. Perkins. Henry Miller, James M. Perkins and Christian Sherk all signed the indenture. Christian Sherk's signature appeared in German gothic script. September 17, 1881(sic Solomon Fess died on January 27, 1889) - Solomon Fess Sr. of Rainham, yeoman, died. His will appointed his "trusty friend" Joseph Sherk and son, Samuel Fess as executors. His will left all his real estate, houses and tenements, including 100 acres of the south east part of the lot, to his wife while she remained his widow. His sons Adam, Samuel and Solomon Fess, were to receive $1.00 each, having already received their proportion. His sons, Henry and John Fess were each to receive $500.00. His daughters Susan, Catharine and Louisa Fess were each to receive $300. After the death or remarriage of his wife, all the real estate and property were left to Frederick Fess, subject to the payment of the above legacies. Payment of the legacies was to be made within 2 years after his death. If the legacies were not paid, the executors were to sell the land. All of the remaining money, goods and chattels were left to his wife. Any debts that remained after his death were to be paid by his wife from the profits of the farm. If she refused to pay them, all the children were to be taxed by the executors. The will was signed by J. W. Holmes of Selkirk, yeoman, and Hezekiah Sherk. An "x" was identified as the mark of Solomon Fess Sen. Haldimand Registry RH 3548 From - Plain Folk Houses of Rainham and South Cayuga - by David McClung and Timothy Silk #21 The Fess House Solomon Fess was born in Germany about 1814 and his wife Margaret was born there five years later. Both were Mennonites. They were in Canada by 1840 and bought the east half of Lot 4 in the second concession of Rainham in 1844, They first lived in a log house, but by 1861 had a two-storey brick house. This house still stands, but is covered with aluminum siding (LIX). Along with # 14, which is almost a full two storeys high, it is the only four-bay, two-door house in which the doors are the two outside bays. It is probably also the oldest surviving example of the tall, square, hip-roofed, Italianate or bracketed-inspired four-bay, two-door house which became very popular throughout the two townships under study. The main floor plan features two front rooms with a row of smaller rooms and a stair behind. The stair, on the west side of the house, is unusual in that it begins parallel with and adjacent to the back wall of the house, then turns 90° toward the centre of the house about halfway up. It rises into a small square hall with a short corridor, off the two of which open a total of five bedrooms. There is a diagonal wall similar to that of #22. Finally, there is a large attic reached by a secong set of stairs. The house and farm stayed in the Fess family until 1945, when it was sold to Hoovers. July 24, 1880 - Frederick Yager, yeoman, and his wife Mary Elana, Josiah Sherk, yeoman, and his wife Eliza Ann, all of Rainham and all heirs of the late Jacob Yager, sold and quitclaimed the south half of Lot 6, containing 50 acres, and the south east corner of Lot 5, containing 50 acres. The transaction was witnessed by Willard Derby of Rainham, clerk. His signature appeared on the indenture with those of Eliza Ann Sherk, Josiah Sherk, Mary Elana Yager, and Frederick Yager. August 16, 1880 - Abraham Yager of Clinton, Lincoln, labourer, sold and quitclaimed the south half of Lot 6, containing 50 acres and the south east corner of Lot 5, containing 50 acres, to Frederick Bretzler of Rainham, yeoman, for $13. Eliza Ann Westerman was the daughter of Amos Yager and Angelina Wardell. Angelina died in 1864 and by the time Amos died in 1868 he had found homes for his children. His widow MARY McBURNEY MURPHY and son John are on the 1852 and 1861 Census of Townsend. In 1852 they are in a 1 1/2 Storey Log House and James G. is with them, in 1861 they are in a 1 Storey Log House. Mary died in Walsingham in April of 1871 just before the Census was taken, her death is registered on the 1871 Census of Walsingham as a death during that year. His son THOMAS MURPHY is married to Catherine Murray, they are on the 1852 Census of Chinguacousy, Peel County where he is listed as a Teamster, he has two sons James G. and John. They appear to be living just below Brampton working for George Wright Esquire MPP who owns a grist and saw mill there. The fourth, fifth and sixth children are born in Townsend Township, his eighth child is born in Walsingham Township. On the 1863 Tremaine Map Thos. Murphy is on the South Half of Lot 23, Concession 13, 100 acres, in the Township of Townsend. In the 1877 Atlas Thos. Murphy is on the North Halves of Lots 15 and 16, Concession 8, Walsingham Township. Big Creek runs through his farm, pretty much on the lot line between Lots 15 and 16. His son JOHN MURPHY appears to have lived with his mother until her death in 1871 then went to New Brunswick and married where two children were born, three or four more chidren were born in Townsend where he is listed on the 1881 Census. His wife died in 1884 and he and the children are on the 1891 Census of Moncton, New Brunswick where he is listed as an accountant, when in Townsend he is always a farmer, except when he came back to Townsend and died in 1892 he is listed as an accountant. He and the children appear to be living with two of his wife's unmarried sisters, Agnes and Eunice Brown who are both School Teachers. Two daughters, Ethel and Florence are on the 1901 Census of Moncton, New Brunswick listed as Teachers, still with the aunts. On the 1911 Census of Moncton, New Brunswick Ethel is living with her Aunt Agnes and her husband Hugh McLeod still listed as a Teacher, her Aunt Eunice Brown is listed as a Boarder in the same household. His daughter MARYANN MURPHY is married to Joseph Hagan and they have at least one child, Mary McBurney Hagan, born at Brampton about 1845. In 1852 they are on the Census of Woodhouse living across the road from Maryann's widowed mother Mary and her brothers John and James George, with children James G. and John, living in a one storey shanty. By 1861 Jospeh appears to have died and she has remarried William McKelppin/McCoppin and they are still across the road in Woodhouse Township on Lot 23, Concession 6 Wooshouse owning 33 acres, with James G. Hagan and Sarah McKelppin and her children John and Jane Higgin (sic) are with their grandmother Mary. By 1866 she remarries as Maryann Hagan to Samuel Howell and on the 1871 Census they are still in Woodhouse with daughters Susan Sabina and Margaret Howell, daughter Sarah Ann McCoppin and son James Geo. Hagan. His son JAMES GEORGEMURPHY is married to Susan Carroll in Simcoe, Norfolk County in 1861, his first, second and third children are born in Jarvis or Townsend Township, his fifth, sixth, seventh and eighth children are born in Walsingham Township. James George died in Walsingham Township in 1877. Most of the Murphys of the first and second generation are buried in Carholme-Knowles Cemetery on Lot 18, Concession 9, Walsingham Township, and always listed as Presbyterian on the census and death records. From the 1863 Tremaine Map - The line between Concession 14 Townsend and Concession 6 Woodhouse is now No. 3 Highway going to Jarvis. Mrs. Mary Murphy in on Lot 24 and the North East Quarter of Lot 23, Concession 14 Townsend, 250 acres. Thos. Murphy is on the South Half of Lot 23, Concession 13, Townsend, 100 acres. It’s likely living with Mary and her son John is another son James George Murphy, who was married in Simcoe in 1861, as his second son Thomas C. Murphy born 1865 says he was born at Jarvis and his daughter Mary born 1866 was born in Townsend Township. Across the road on the East Half of Lot 23, Concession 6, Wooshouse, 100 acres, is J. Hagan, a son in law who was married to Maryann Murphy. There are water-powered saw mills both above and below them on the Nanticoke Creek.
